Judge dismisses Monsanto’s Arkansas lawsuit

An Arkansas judge has tossed out Monsanto’s lawsuit against the Arkansas Plant Board Friday.

Monsanto sued the state agency after it banned dicamba use between April 16th and the end of October. Sixth District Circuit Judge Chris Piazza referred to a State Supreme Court ruling that makes it harder to sue the state, and he didn’t see how the Monsanto suit could go forward when the Plant Board has immunity from lawsuits.

Monsanto Vice President Scott Partridge issued a statement saying, “Unfortunately, the Plant Board has placed unreasonable restrictions on the use of this (XtendiMax) technology in Arkansas. We are disappointed in the court’s decision to dismiss our legal challenge of the Plant Board’s restrictions and we will consider additional legal steps that might be appropriate.”

Judge Piazza commented on the State Supreme Court ruling which appears to give blanket immunity to state agencies saying, “It’s obvious that Arkansas is going to have to come up with a constitutional amendment to change this to make it where we can operate again as a court should.”
